Claims/Contract Manager

We are seeking an experienced Contract/Claim Manager with a proactive,

Candidates must demonstrate
- on expertise in EPC contract management during the selection process and have extensive experience in EPC project contracts, within the Nuclear sector. A background in managing contracts of varying size and complexity across the EMEA region is essential, along with familiarity with FIDIC (Yellow Book), NEC3, and other bespoke contracts.
Your responsibilities will include managing commercial aspects of contracts, collaborating closely with Project Managers to assess and mitigate risks, and ensuring that all contract stipulations are fully understood and followed. Your proactive leadership will be crucial in facilitating commercial discussions with clients and suppliers, preparing necessary documentation, and driving contract variations and negotiations.
Requirements
Key Responsibilities:
- Develop and implement standard contract procedures globally and across the portfolio according to the team's overall strategic plan.
- Draft contracts and agreements in accordance with international standards to safeguard the company's interests.
- Conduct team training sessions to ensure that all contract and claims stakeholders have met their responsibilities and obligations.
- Develop a contract management detailed strategic plan aligned with the company policies, the stakeholders' requirements, and the overall strategic plan considering schedules, cost, scope, and risks.
- Provide contractual support and leadership on incoming and outgoing claims. Establishes and enforces standard change methodologies in portfolio of contracts to
- identify changes and quantify the additional time and compensation due, defines approval requirements and communicates changes to the customer.
- Contract execution (from project
- off to project closure) Identifies the contract baseline (including terms and conditions, specifications, drawings, estimate, proposal, schedule and other documents incorporated in the contract) and highlights areas of potential risk. Ensures timely and accurate execution of commercial aspects in portfolio of contracts (i. e. payments, claims, variation orders, warranties, provisions, guarantees, etc. ). - Ensure the earned value concept in all the contract management activities.
- Responsible for preparing and consolidating all the required documentation to manage claims and counterclaims in support of negotiations.
- Responsible for monitoring contract obligations and notifying the relevant parties in case of deviations.
- Review official correspondences to ensure alignment with the contractual obligations and commitments.
- Provide clear contractual analysis and advice to the organization on matters concerning contractual obligations, contract risk, and claim management.
- Collaborate in preparing the project closing report and summarizing lessons learned for feedback to the organization relevant to Contract Administration.
- Experience of contract law, contract drafting, administration and negotiation of change orders, and effective correspondence.
- Ability to interface with customers on issues ranging from administration of the contract to all matters relating to the review and process of changes.
- Ability to evaluate the legitimacy of a claim as well as understand and interpret the main contract provisions by challenging costs, and how these affect scope and schedule.
Essential Qualifications:
- The ideal candidate holds a university degree in Quantity Surveying, Business Administration, Law, or a related field.
- 15 years of experience in contract and claims management combined with project management expertise.
- Proficiency in communicating on all issues concerning contractual agreements and amendments.
- Experience with construction management software and tools for efficient contract administration and claim management.
- Proficiency in international contract standards such as FIDIC, NEC, IChem
E and other relevant standards. - Expert in resolving disputes and conflicts that may arise during the project, employing mediation or alternative dispute resolution methods.
- Previous experience of working on large scale Nuclear Projects
- Capacity to operate on a project site or corporate office basis.

- Direct involvement in a CANDU Refurbishment Project/Organization will be an advantage
